Under the Designs Act 2000, any new and original shape, pattern, ornamentation, or composition of lines or colors applied to any article that appeals to the eye can be registered. The design must be visible on the finished product and not merely functional. Industrial designs, packaging designs, textile patterns, and product shapes are commonly registered.

Design registration typically takes 12-18 months in India. The application is first examined by the Controller of Designs for formal compliance. If accepted, it is published in the Designs Journal. If no opposition is filed within 3 months, the design registration certificate is issued.

Design registration cost starts from Rs. 4,999 including government fees and professional charges. Government fees are Rs. 1,000 for individuals and small entities, and Rs. 2,000 for large entities per design. Copyright protection under the Copyright Act lasts for 60 years but does not cover designs applied to more than 50 articles commercially. Design registration is stronger for commercial products.

A design must be new or original and not previously published or disclosed in India or elsewhere. However, the Designs Act 2000 provides a grace period of 6 months from the date of first publication within or outside India to file the application. The registered proprietor has exclusive rights to apply the design to any article in the registered class. Penalties include fines up to Rs. 25,000 per infringement and imprisonment up to 2 years for repeat offenses.
